foodandfriends wishes to inform users of its website of its policy regarding the processing and protection of personal data belonging to those individuals who voluntarily use email to contact us or make use of any other service on the website that involves the provision of their personal data.
For these purposes, ‘personal data’ shall be understood to mean any information relating to identified or identifiable natural persons – including email addresses and/or IP addresses – and ‘user’ shall be understood to mean any identified or identifiable natural person who provides their personal data tofoodandfriends through the use of any service on the website of the aforementioned organisation.

2. Identification of the name of the data controller

foodandfriends informs users of its website of the existence of a personal data processing file for which it is the data controller, with its registered office at Acaia 3 – 07610 Palma de Mallorca, where the personal data provided by users is collected and stored.

3. Purposes for which personal data is used

foodandfriends does not request data from users visiting its website; therefore, the provision of personal data by the user via the website can only be deemed to take place when they voluntarily use the email service or the ‘contact’ section to get in touch with us, given that in these cases the processing of data is unavoidable and inherent to the communication system used by the user.
In these cases and those described in section ‘4’ below, foodandfriends informs users that data processing is carried out for the following purposes:
To carry out all procedures relating to the contracting and provision of foodandfriends services to data subjects who request them in their own name and on their own behalf; to handle and reply to communications received; and to maintain records of commercial relationships.

4. Consent

foodandfriends informs users of its website that this privacy policy covers all aspects relating to the processing of personal data carried out by us as the data controller.
Thus, where the user does not have a business relationship with foodandfriends, they must bear in mind and are hereby informed that sending an email or providing any other personal data entails or implies the giving of their free, unambiguous, specific, informed and express consent to the processing of their personal data, for the purposes set out in section “3” of this privacy policy, as well as to respond to their enquiry or send them information. If, on the other hand, the user does not agree, please refrain from sending emails or providing your personal data to Food and Friends.
For the same purposes, foodandfriends also informs users that, if they send an email or provide their personal data by virtue of the position they hold within a company – whether as a director, manager, representative and/or in any other capacity as a contact person for that company – it will be understood that such communication constitutes their free, unambiguous, specific, informed and express consent to the processing of their personal data, for the purposes set out in section “3” of this privacy policy, as well as to respond to your enquiry or send you information. If you do not agree, please refrain from sending emails or providing your personal data.

5. Request for information

Where the user, whether acting on their own behalf or on behalf of or as a contact for a legal entity, considers that the information provided in this policy is insufficient or lacks clarity, specificity or detail, we ask that, before sending us an email and consequently your personal data, you request any additional information you deem necessary by sending a written communication by post to the registered office address indicated in section “2” of this policy.

6. Identification of the recipients to whom foodandfriends intends to transfer or disclose data

foodandfriends only intends to transfer or disclose data which, pursuant to Article 11.2.c. of Organic Law 15/99 on the Protection of Personal Data (hereinafter the LOPD) in order to fulfil its obligations to public authorities in cases where this is required in accordance with the legislation in force in each area at any given time and, where applicable, to other bodies such as judges, the Public Prosecutor’s Office, the courts, the Court of Auditors or the Ombudsman.
foodandfriends hereby informs the user that any other transfer of data that it is required to carry out will be brought to the user’s attention where so provided for by the LOPD, informing the user expressly, precisely and unequivocally of the recipients of the information, the purpose for which the data will be used, and the nature of the data transferred; or, where applicable, where the LOPD so provides, the user’s unequivocal, specific and informed consent will be sought in advance.

7. Other recipients of information

Notwithstanding the provisions of the previous paragraph, foodandfriends informs the user that any processing of personal data is subject to the data protection legislation in force in Spain, as set out in the LOPD and its supplementary and implementing regulations.
In this regard, foodandfriends is solely responsible for, and guarantees the confidentiality, security and processing of data in accordance with this policy, in respect of the personal data it requests from the user via the website www.foodandfriends.com It accepts no liability whatsoever for the processing and subsequent use of personal data that may be carried out by third-party information society service providers who may access such data in the course of providing their services or carrying out their activities.
Third-party information society service providers shall be understood to mean – without limitation – those natural or legal persons who provide the following services:
a) Transmission via a communications network of data provided by the recipients of the service. b) Services providing access to the aforementioned network. c) Data storage or hosting services. d) Provision of content or information.
Furthermore, foodandfriends accepts no responsibility for the processing of data carried out by third parties that provide hyperlinks to our website, nor for those parties to whom foodandfriends directs its visitors via hyperlinks.

8. Data quality

foodandfriends warns users that, unless they have a legally authorised power of attorney, no user may use another person’s identity or disclose that person’s personal data. Users must therefore bear in mind at all times that, when using email, they may only include personal data relating to their own identity, and such data must be appropriate, relevant, up-to-date, accurate and true. To this end, the user shall be solely liable for any direct and/or indirect damage caused to third parties or to foodandfriends through the use of another person’s personal data, or their own personal data where such data is false, erroneous, out of date, inappropriate or irrelevant. Similarly, any user who uses a third party’s personal data shall be liable to that third party for the duty to provide information set out in Article 5.4 of the LOPD where personal data has not been collected from the data subject themselves, and/or for the consequences of failing to inform them.

9. Data relating to minors or persons lacking legal capacity

If the user is a minor or lacks legal capacity, foodandfriends advises that consent must be obtained from their parents, guardians or legal representatives before providing their personal data. We therefore ask that you refrain from using the email service if you do not have the consent of your parents, guardians or legal representatives; otherwise, we shall not be liable for the actions of the minor or person lacking legal capacity.

10. Data update

The user is the sole source of information regarding their personal data; therefore, foodandfriends kindly requests that, in order to keep their data up to date at all times in accordance with the principles of the LOPD, they notify the address provided for the exercise of the rights of access, rectification, erasure and objection, any changes to such data, as well as the termination of your role with the organisation you represent, where applicable, so that we may proceed with the deletion and/or historical processing of such data.

11. Exercising the rights to object to, access, rectify and erase data

foodandfriends informs users that they may exercise their rights of access, rectification, erasure and objection by sending a written request, accompanied by a copy of their national identity card, to the following address: Acaia, 3 B3 3B – 07610 Palma de Mallorca, or to any address that may replace it and is notified to the General Data Protection Register.
